review of a decision by the Circuit Court of Prince William (Virginia), which
convicted him of reckless driving in violation of Va. Code § 46.2-852 and
overruled his motions to set aside the verdict and for a new trial.

Court made the following holding:
- Where an offense is
punishable with a higher penalty, because it is a second or subsequent
offense of the same kind, the more severe punishment cannot be inflicted
unless the indictment charges that it is a second or subsequent offense.
Under rules of criminal pleading the indictment must contain an averment
of facts essential to the punishment to be inflicted.
- The court determined
that the warrant charged defendant with reckless driving and did not
mention his prior conviction. The court concluded that defendant should
have been tried for the offense as charged and not for any other. The
court found that the original indictment did not charge defendant with a
second offense and that no timely amendment was made to include such an
offense in the indictment.
